Hicks & Gillett stand 2 lose a total of £254 million if the move by the owners of the Boston Red Sox collapses & they kannot find a replacement new owner by Friday. ESPNsoccernet k exclusively reveal the cornerstone of Liverpool's case @ the High Court next week is tat the takeover is in everyone's best interests. The hearing is not likely until Tues @ the earliest. An inside source said: "It's in Hicks & Gillett's best interests, the board will argue, becos it caps their losses @ £144 million. Part of the deal with NESV is tat RBS wipe out the £110 million of personal guarantees." An out of court settlement with Hicks & Gillett kannot be ruled out as the board is so confident tat they will win the case. Liverpool chairman Martin Broughton kannot comment on the specifics of the case, but he has told ESPNsoccernet tat he believes he k win the case & the takeover k go through. Behind the scenes 'negotiations' r clearly going on between the warring factions aimed @ avoiding a messy public court hearing tat would tear the club apart. Equally, the court hearing, which comes just days b4 Friday's deadline with RBS, is unlikely 2 be the end of the legal wranglings, as whoever losses the initial hearing is sure 2 seek an appeal. On the issue of an appeal, Liverpool's lawyers will argue tat if Hicks & Gillett lose & the takeover k go through, & they call 4 an appeal, it would seriously jeopardise the takeover, & potentially throw the club into administration, thereby putting the club's survival @ risk. If the legal actions drag 2 a 2nd hearing, it is inevitable tat RBS will have 2 take some decision on Friday, most likely 2 suspend the outcome of whether to put the club in2 administration pending the final court room verdict. The logical solution is 4 both sets of lawyers 2 find some sort of middle ground, even if it is a settlement on the steps of the High Court. There is no direct contact anymore between the factions, with Hicks & Gillett on 1 side & the 3 English members of the board led by Broughton on the other. Broughton told ESPNsoccernet exclusively: "All of these issues I kannot possibly comment on, as tis is going 2 court, 1 would assume. We hv no date 4 the hearing yet, but we r told it is a 'short order' & so it would be any day hopefully early next week. The lawyers hv told me I am not 2 talk abt the case directly." However, w/o going into any legal detail, Broughton said: "Yes, I am confident we shall win. However we all know when you hv 2 sets of lawyers they r both telling you tat they r 100% confident tat they will win." There is 1 central key issue of the entire legal procedure, & Broughton made tat abundantly clear: "We r going 2 the courts seeking clarification tat we r able 2 proceed with the sale of Liverpool FC." Although Hicks publicly declared tat he had given no undertaking directly 2 Broughton abt the constitution of the board & the sale process being determined by the board (rather than the shareholders when he did his deal with RBS 2 extend the facility for 6 months), Broughton confirmed tat such an undertaking was given 2 RBS. Broughton said: "The obligation was given 2 RBS as part of the loan extension agreement. If an undertaking was given 2 the major creditor, than an undertaking was given." In another twist, leaked minutes fr a Liverpool board meeting allegedly contain Hicks making personal & abusive comments abt Liverpool fans, which will increase the hatred already felt by the supporters against the current owners. |

Bro, thanks but no thanks. The report only stated that IF LFC goes into administration and that they are deducted 9pts, only then will the deal NOT goes through. Its not a definite senerio yet, just a probabilty. U are jumping the gun.

I'm disappointed that the sports reporters from Straits Times or Newpaper didn't interview Peter Lim yet. We are reading news of Peter Lim's bid from international news sources? Hello New Paper, what the hell are you doing? When news broke out that it's Peter Lim who's bidding, New Paper should be camped outside his condo to wait to interview him or his beautiful wife Cherie Lim.. I think whichever local reporter can get a report, that report will surely be published all over the world.
